Armenia refuses to comply with arbitration ruling on ENA — Srbuhi Galyan

Armenian Minister of Justice Srbuhi Galyan spoke to journalists about the arbitration decision concerning the Electric Networks of Armenia (ENA).

“When we talk about international arbitration and the enforcement or non-enforcement of its rulings, the following should be noted: Armenia is a party to the New York Convention, which stipulates that if a state does not voluntarily comply with an arbitration decision, it must—or may—be enforced through compulsory measures,” Galyan said.

According to her, the mechanism of compulsory enforcement involves implementing the arbitration decision based on a court judgment.

“At this stage, the international arbitration has essentially issued a decision regarding interim measures. This decision is not being voluntarily enforced by the government, but there is a mechanism for its compulsory execution. There is also a possibility of non-enforcement if the court finds that the decision contradicts public policy,” she added, emphasizing that these provisions are enshrined both in international legal instruments and in Armenia’s domestic legislation.
