Vahe Grigoryan: Not all the police requirements should be considered legal

The police abuse the use of the term “legal requirement”, constitutional law expert Vahe Grigoryan told Alpha News.

“The police abuse the use of the term ‘legal requirement’ and present any requirement as legal. For example, the legal requirement to clear the road has a number of grounds and justifications. If the gathering was announced beforehand or was spontaneous, then in that case, in my opinion, it is clear that a legal demand to open the road cannot be made. That requirement in itself is not legal,” Grigoryan said.

The expert emphasized that each requirement should be studied to understand whether it is legal or not.

“Even if the alleged legal requirement is in fact legal, a reasonable period of time must be allowed for its fulfillment. We often see that administrative detention may take place even without a legal requirement. Each case should be examined individually to find out whether the police requirement was legal and lawful or not. Undoubtedly, any requirement cannot be considered legal by itself, and not all the police requirements should be considered legal,” Grigoryan concluded.
